Terms and Conditions

Please take a minute to read the following terms which apply to all purchases made using this website

General

  1. The owner of this web site is Swissvax LLP whose address is Unit 14 Nidd Valley Business Park, Lingerfield, Knaresborough, HG5 9JA (“Swissvax UK/we/our/us”). We are a limited liability partnership registered under number OC316595
  2. Your contract for purchases made through the Site is with Swissvax UK
  3. Our contract is made when we dispatch the product(s) ordered. All contracts are made on these terms and conditions (“Our Terms”) which may be amended from time to time as set out in clause 24.
  4. You undertake that all details you provide to us for the purpose of ordering or purchasing goods or services are correct and that the credit or debit card you are using is your own or you have authority to use it.
  5. We will always treat the information we collect from you as personal and confidential. Your details will only be used to complete orders, provide you with the best possible service and, if you have requested, to enable us to send you information about promotional offers and new products or services. Your personal information will not be passed or sold to any third party or company (unless we are legally obliged to) without your permission.

    Order processing

  7. Payments can be made by debit or credit cards. Credit and debit cards are debited on the day we ship. All prices include sales taxes (where applicable) unless otherwise stated; delivery is added to your order as set out in your order basket.  Charges for delivery are set out on the site. All goods remain the sole property of Swissvax UK until paid for in full.
  8. We aim to arrange shipment of all ‘in stock’ items within 48 hours of receiving your order. Your order may be delayed if the item is not in stock. If the item you have ordered is not in stock, we will do our best to get it for you as quickly as possible. If you have ordered a number of items, we will contact you by email and may, at our discretion, split the order and supply you with available items, with the out of stock items to follow. 
  9. You may cancel your order at any time prior to your order being processed by email to orders@swissvax.co.uk or by post or by telephoning 0870 240 7530 during normal office hours.
  10.  If you are a private consumer (and by this we mean you have bought the product other than for your own business), you may also withdraw from the contract at any time after the product has been dispatched and you have received our email confirming your order if you notify us within 7 working days after the day after you receive the product by returning the cancelled item(s) (unopened and in original condition) at your own expense to the address shown on the invoice. We will refund the order or relevant part of it as soon as the goods have been received back.  It may take us up to 30 days to do this.
  11. As well as your cancellation rights set out above, if you are a private consumer, we are happy to accept any stock items for exchange or refund within 28 days of receipt of goods, provided the item is returned unused and in its original condition. Incorrectly ordered, or stock items returned will however be subject to a 20% restocking charge. Non-stock/special ordered items may not be returned unless specifically agreed by ourselves beforehand and will be subject to a minimum 20% handling charge. We will refund the order or relevant part of it as soon as the goods have been received back.  We will do this within 30 days.
  12. We recommend that you use a registered postal service to return your item. Swissvax UK will not be held liable for the cost of return or lost parcels. Alternatively you can take the goods, along with your invoice to our premises at Unit 14 Nidd Valley Business Park, Lingerfield Knaresborough HG5 9JA where our staff will be happy to exchange or refund your goods.

    Delivery

  13. We are able to deliver to most countries. However we may need to contact you for more information prior to shipping outside the UK. In most cases we will use Citi-link to deliver your goods.
  14. We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including problems with Royal Mail or Citilink.

    Liability

  15. This section applies only to the extent permitted by law. For the avoidance of doubt, we do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from our negligence or wilful default, or that of our employees, agents or subcontractors or (b) fraudulent misrepresentation.
  16. We do not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services.
  17. We will do our best to correct errors and omissions as quickly as practicable after being notified of them.
  18. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall, at our own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question PROVIDED THAT you notify us of the problem in writing at the address stated in the confirmation e-mail within 10 working days of delivery of the goods. NOTHING IN THIS CLAUSE AFFECTS YOUR STATUTORY RIGHTS.
  19. You and Swissvax UK will only be liable under these Terms for losses which are a reasonably foreseeable consequence of the relevant breach of contract, and in any event Swissvax UK’s total liability for loss or damage under this contract shall be limited to the total cost of your order.

    Miscellaneous IT stuff

  22. Subject to the licence granted to you to use the Site, Swissvax UK reserves all rights, title and interest in its Intellectual Property Rights in the Site. Any goodwill accruing from use of Swissvax UK and its affiliates’ trade marks, trade and business names and service marks under this Agreement will vest in Swissvax UK and its affiliates, as appropriate.
  23. We may amend our Terms from time to time, and place the new version on the Site. When we do so, it will mention the fact on our home page (www.Swissvax.co.uk). For users purchasing goods or registering on the Site for the first time, all purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms. Otherwise, such changes will be effective against existing users thirty days following posting of the amended version on the Site. Your continued use of the Site following our posting of any changes will constitute your acceptance of such changes. If you do not agree to any changes to our Terms, then your only remedy is to cease using the Site.
  24. As you browse our website, cookies are placed on your computer's hard drive. Cookies are small pieces of data that are sent to your browser from a Web server and stored on your hard drive. Cookies allow us to track the items you search, browse and display. No other information is stored within your cookie. If your browser is set to not accept cookies, you may not be able to use our website or service.

  26. We have implemented technology and security features, as well as strict internal guidelines, to safeguard the privacy of your personal information from unauthorised access or improper use. We will continue to enhance our security procedures as new technology becomes available. While we make every effort to ensure that your information is secure on our system, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, we cannot guarantee the security of any information you transmit to us, and you do so at your own risk.
